A drink-driver who crashed his car on a slip road told cops he was distracted – because he was peeing into a beer can. James Howard, 53, was arrested after his Chevrolet ploughed into a white Volkswagen while three times over the limit.
A police officer who arrived at the crash scene reported seeing Howard with “a large Budweiser beer can in his right hand, which he moved into the centre console”. But when he was asked what was in the can, he “said it contained urine and not beer”, police said.
An affidavit read: “He further explained that he ‘rear-ended the vehicle because he was attempting to urinate into the beer can while driving’.” The arrest report added his pants were wet with urine and “Howard stated ‘I’m going to jail for a f*****g long time.'”
Police in Montana in the US were called on Saturday, November 8, to a two-car bump on a highway slip road. When they arrived, a state trooper noticed a strong smell of alcoholic beverage on Howard’s breath and his speech was slow and slurred.
The Volkswagen driver told cops he saw headlights approaching in his rear view mirror and told his girlfriend to brace for impact. Their vehicle was then struck from behind.
Howard then got out of his vehicle and apologised for the accident and they moved their vehicles to the parking lot after waiting approximately ten minutes for police to arrive.
The trooper administered the horizontal gaze nystagmus test on Howard and noted six of six standardised clues for being drunk. Howard did not agree to perform the walk and turn or one-legged stand test, telling cops: “I just can’t do it.”
He admitted top police he had “more than a couple of DUIs and was not supposed to be driving,” the affidavit notes. A check of his driver history showed his license had been suspended earlier this month, and that he had four prior impaired driving convictions.
A post-crash test registered his blood alcohol concentration at more than three times the legal limit. Court documents state Howard’s driver’s license was suspended as of November 9, 2025.
Howard has prior impaired driving convictions in North Dakota in May 2025, Montana in 2007, 1995, and 1994.
He is currently being charged with felony aggravated DUI, driving with a suspended license, and careless driving. His bond was set at $10,000.
